We take no responsibility for any loss or damage suffered as a result of our "gold recycling/buying" service, our "order online" service, or goods supplied using it, except as required by law, even if we could have foreseen the loss, or the possibility of it was brought to our attention.

  • fraudulent misrepresentations
  • the quality of our goods

General

These Terms & Conditions of use are governed by the law of England and you and we agree to use the English courts if there is any dispute between us.

If any part of these Terms & Conditions of use is found to be invalid by law, the rest of them remain valid and enforceable.

Terms and Conditions - When Buying Online

By placing an order using this service you are accepting these Terms & Conditions. Please read these Terms & Conditions before placing an order. These Terms & Conditions only apply to goods purchased online using this website.

In these Terms & Conditions

"We" and "us" means Browns Jewellers and Pawnbrokers Limited.

"You" means the person placing an order.

"The contract is agreed" - by completing and submitting an electronic order form, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract - See Ordering process below.

"Working days" means all days other than Saturdays, Sundays and English statutory and public holidays.

By using the website to buy goods online, you confirm that you are at least 18 years old, or, if you are under 18, that you are placing an order on this website with the consent of your parent or guardian. We do not sell goods to children online, but we do sell children's goods for purchase by people over 18.

Ordering, cancelling before despatch and returning after despatch

Ordering

Please see our shopping with us guide for instructions on placing an order.

By completing and submitting an electronic order form, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. Please note orders will only be despatched once we have authorisation from your payment card issuer. We will not be liable if there is a delay, and we will not accept your order if payment is not authorised.

Certain steps must be followed for a contract to be formed, as described below.

After you have placed your order:

  • We will send you, as soon as possible, an email to acknowledge your order. It will confirm which goods you have ordered. This email is not an order acceptance from us.
  • When we dispatch your goods from the warehouse, we will send you a confirmation email. This email constitutes a formal acceptance of your order by us. This also means that a contract between us is agreed and we are obliged to fulfill our obligations under this contract.

We do not have to accept your order, and for example, we will not accept your order if:

  • we do not have the goods in stock
  • your payment is not authorised
  • there is an error on our website regarding the price or other details of the goods
  • you have cancelled it in accordance with the instructions below

We reserve the right to refuse any order.

Cancelling an order before despatch

If you change your mind after placing an order, you can cancel it at any time before we despatch it. Please see the contact us page for our telephone number. You will need to give us your name and address details, as well as your order number to cancel your order returning goods after despatch

Cooling off period

When you order from us online, you are entitled to a cooling off period after despatch, when you can return your goods without any penalty. Our cooling off period is 30 days, which includes any statutory cooling off period.

This period starts the day the contract is agreed (i.e. you receive an email from us saying we have despatched your order) and ends 30 days after the day following delivery of the goods.

Certain items are excluded from the cooling off period guarantee, unless we are at fault. These are personalised or engraved items.

Returning Goods

Please refer to our returns & exchanges page for details of how and where to return goods.

If you wish to return goods you have a duty to keep them in your possession and to take reasonable care of them until you return them. Please telephone us on NUMBER HERE if you would like to return your order, Goods must be returned in their original condition, including immediate packaging, within the cooling off period.

* Calls are charged at local rate and may be recorded. Our lines are open 9am-5pm Monday to Saturday.

We accept refunds or exchanges of pierced items in original packaging. If you would like to return your purchase please ensure the plastic bag containing your order remains sealed. If the items have been removed from the bag or if the bag has been tampered with, we cannot refund or exchange the item due to hygiene reasons.

Our returns policy does not affect your statutory rights. For further information on your statutory rights look at www.consumerdirect.gov.uk.

Product Availability

Our website only shows goods available for purchase in the UK, including Northern Ireland. We are unfortunately unable to dispatch goods to addresses outside the UK, or in the Channel Islands.

Pricing and Payment

Prices throughout the website are quoted in Pounds Sterling, and payment can only be accepted in Pounds Sterling. Prices include VAT. Packing and delivery costs will be added to the total price of your goods. Prices quoted on the website are applicable exclusively to goods purchased through this website.

While we make every effort to ensure that the goods shown on our website are currently available at the price shown on the website, we cannot guarantee that this will always be the case. If goods you have ordered online are unavailable, you will be notified as soon as possible.

If a pricing error is made on our website or in the ordering process we will inform you as soon as possible and give you the option of buying the goods at the correct price or cancelling the order. Your order will be cancelled if we cannot get in contact with you to notify you of the error.

Your payment card will be debited for your order on the day that we despatch your goods.

Disability and Discrimination

At Browns Jewellers and Pawnbrokers we are committed to all our customers and make every reasonable effort to ensure the welfare of our customers with disabilities whilst they are shopping with us.

We take all reasonable steps to ensure our building are accessible to all our customers, if this is not reasonably possible we communicate to our staff the reasons why the adjustment was not possible and place alternative methods of contacting in store staff for those who find it difficult to enter our premises.

What information do we collect from you?

We will only collect information about you if you willingly provide it. The information you provide which is about you is referred to as personal information.

In order to do any of the following, you will need to provide us with certain details:

  • place an order
  • request a gold recycling/buying pack
  • be contacted by us so that we may notify you of our offer to buy your goods under our gold recycling/buying scheme or answer any queries in relation to the proposed sale
  • make a payment to you under our gold recycling/buying scheme

The details you provide may include your name, email address, delivery address, telephone number, credit or debit card number and the card's expiry date.

We may collect your IP (Internet Protocol) address to help diagnose problems with our server and to administer the website. An IP address is a number that is assigned to your computer when you use the Internet. Your IP address is also used to help identify you during a particular session and to gather statistical data.

How will we use it?

We will use this information to fulfil any order, to fulfil any of our services (including for instance under our gold recycling/buying scheme) and to communicate with you when necessary. If you provide us with your debit or credit card details, we will record them so that you can save time and use them when you next order with us.

We may also use these details for validation checks, as outlined below.

We may also use your personal information to contact you about news and offers that we think may interest you, or to tell you if we change anything important about how the website works, or the terms of use of the website.

Please note that if you telephone us, or we telephone you, calls may be recorded for training purposes and/or to provide evidence of the terms of any agreement we may enter into, including in respect of our gold recycling/buying scheme.

Will we share your personal information with anyone else?

We may want to share your personal information with other reputable companies and businesses working with us, such as our email provider. We will never release your personal details to any outside company for mailing or marketing purposes.

Payments on the website are processed by a third party, which adheres to the privacy policy that is set out here. We have a non-disclosure agreement with this third party, and they are certified by all the major card issuers to hold details securely.

Validation checks

All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery. We may need to contact you by letter, telephone or email to verify details before we are able to process and dispatch your order or we may be unable to accept your order. Any information given may be disclosed to a registered Credit Reference Agency which may keep a record of the information. All information provided will be treated in accordance with the Data Protection Act 1998. These measures are taken as extra protection for you, to ensure your online shopping experience with us is as safe and secure as possible and to assist in the prevention of crime.

How long will we keep your information?

We will only keep your personal information for as long as necessary and consistent with the purpose for which you have given it to us. Except where needed to respond to a query from you or to fulfil an order or to complete a transaction under our gold recycling/buying scheme, we will delete your personal information on request by you.

We want to make sure that your personal information is accurate and up to date; therefore you may ask us to correct or remove information you think is inaccurate.

Returns and Exchanges

You can return items to us free of charge - the card you used to pay will be refunded within 28 days. What you need to do:

  • Contact our Customer Services Team 01423 740201
  • We will send you a letter with pre-paid labels to attach to your parcel so postage will be free.
  • Place the items into their original presentation boxes and make sure the parcel is sealed securely. You should also place a copy of the despatch note you received with your order into the parcel. Please note that pierced jewellery must be returned in its original sealed packaging.
  • For refunds: once we have assessed the items, the money will be put back on to the credit/debit card that was used to place the order online.

This returns policy does not affect your statutory rights.
